When you engage a subscription design team, clearly define ownership of deliverables from day one. Statements of Work (SoWs) should specify whether rights transfer on payment, on acceptance, or upon completion of milestones, and should explicitly cover code, assets, and derivative works such as design tokens. Ambiguity here can create downstream disputes and slow releases.
Beyond IP, address confidentiality and data handling in the contract. Subscription teams often work across verticals and clients; require scoping for PII, anonymized research data handling, and secure access protocols for staging environments. For regulated industries, include clauses about audit support and compliance with standards like GDPR, HIPAA, or PCI where applicable.
Also consider termination and exit provisions that preserve continuity: deliverable handover timetables, escrow for design system assets, and transition support hours. Clear liability limits and an agreed dispute resolution process reduce risk. For in‑house hires, many of these concerns are implicit; for subscription teams, they must be explicit to protect both parties and keep product timelines intact.
