Contracts must explicitly state who owns final deliverables and derivatives, and how work-in-progress is treated. Many subscription vendors are willing to assign IP for deliverables but reserve rights to reusable patterns or tooling; if you need exclusive ownership of a system or component library, negotiate that up front and expect a pricing change.

NDAs and data handling are especially important when designers access player data, telemetry, or proprietary algorithms. Define minimum security standards, restrict production data access where possible, and integrate the vendor into your incident response plan. For sensitive verticals (finance, healthcare, defense) consider background checks and on-premise requirements.

Operationally, require handover checkpoints, canonical repositories for tokens and source files, and a clause for transition assistance if you bring work in-house. These practical contract elements reduce surprises and protect continuity when subscription relationships end.
